Separation Agreements

In general, long before you divorce, you will need to negotiate the terms of your separation. In order to negotiate terms, it is important that you receive and submit full financial disclosure in order to evaluate the value of each asset and determine the value of each debt. Despite recent efforts to simplify the family law system, it remains a tricky legal process and it is important to get things right. Jeff Maxwell heads our family law division and brings a practical approach to navigating the separation process.

Even if you were never married but were common law spouses, or lived for a number of years in a spousal like relationship, you will need a separation agreement to bring certainty to both parties.

You will only require a divorce if you were legally married. Divorce is a federal matter and generally only occurs after the terms of a separation have been finalized.

The family law process takes a child first approach wherein the needs and issues between the parents are subject to the needs and issues of the innocent parties to a separation, the children. Making two (2) homes for children out of one takes some careful consideration and when a reliable schedule can be determined, children fare better.
